SUNNY Cash Back Terms and Conditions

These Sunny Cash Back Terms and Conditions (“Cash Back Terms”) constitute a legally binding agreement between you and Apartment List, Inc., and any Apartment List affiliates (“Apartment List”, “Sunny”, “we”, “us”), governing your use of the cash back feature (“Cash Back”). By claiming under Cash Back, you expressly acknowledge that you understand and agree to the Cash Back Terms and the Sunny Terms of Use, including its arbitration provisions. IF YOU DO NOT AGREE TO THE CASH BACK TERMS AND THE SUNNY TERMS OF USE, THEN DO NOT CLAIM YOUR CASH BACK REWARDS.

1. Eligibility and Program Scope

The Sunny Cash Back program is a voluntary, renter-facing benefit available only for specific eligible listings. To be eligible, you must discover a Cash Back-eligible listing through the Sunny platform (powered by the Apartment List service) and register your interest by contacting the eligible property through the “Cash Back” prompt. and moving into the same property within ninety (90) days of contact. Eligibility is limited to one Cash Back payment per move-in.

2. The Cash Back Process

You must submit a contact form for an eligible property to timestamp your interest. Afterwards, you must sign a valid lease at this property and complete your move-in. Sunny will verify your move-in with the property, but matching your Sunny account email address and/or the phone number you provided to Sunny. Payouts are triggered by a confirmed move-in and you initiating payment when prompted after a confirmed move-in.

3. Payment Terms

Payment will be initiated within approximately 60 days after a move-in has been verified and you have initiated the payment through the confirmed prompt. You must initiate payment within 60 days of move-in or the payment option will expire. Payments are disbursed via Venmo (using the handle provided by you) or by another available - based on your election. Sunny is distributing a portion of its own earned commission to you. This is not a rent reduction, and Sunny is not paying on behalf of your landlord. The underlying lease remains a transaction strictly between you and the property manager. You are responsible for any tax implications resulting from the receipt of Cash Back.

4. Privacy and Data Use

By participating, you authorize Sunny to collect and store your Venmo handle or mailing address for the purpose of processing your payment. You grant Sunny the right to use move-in reports and leasing data provided by properties to attribute your move-in and verify eligibility for Cash Back, along with using anonymized information around move-in and Cash Back receipts in marketing materials. You also authorize Sunny to text you at the phone number provided to update you on the status of your Cash Back. You may opt-out of these texts at any time by replying to the text with “STOP.” Please note that Venmo payments are public by default. Your receipt of a payment from “@SunnyCashBack” may be visible to your network per Venmo’s platform settings.

Sunny reserves the right to modify these Cash Back Terms at any time, effective upon posting on the Sunny website. Your continued use of Cash Back following such modification will constitute your agreement to the revised Cash Back Terms. In the event of any conflict between these Cash Back Terms and the Sunny Terms of Service, the Sunny Terms of Service will prevail.
